Overview
If operators or providers disagree with a decision Alberta Health makes regarding a supportive living accommodation, continuing care home or home and community care, they may be able to appeal it.
Operators and providers may appeal:
- a decision to refuse to issue, amend or renew a licence
- an administrative penalty
- an issued stop order
- a decision to cancel a licence
Where to appeal
The appeals process differs depending on the issue being appealed. There are 2 legislated authorities that accept a notice of appeal:
- an appeals panel
- the Court of Kings Bench
Appeal the following to the Appeals Panel through the Appeal Secretariat:
- Refusal to issue, amend or renew a licence
- Administrative Penalty
Appeal the following through the Court of King’s Bench:
- Stop order
- Cancellation of licence
Appeals Secretariat
Appeals to the appeals panel are made through the Appeals Secretariat.
The Appeals Secretariat:
- is a neutral government office that handle
- appeals decisions made by Alberta Health
- operates separately from the Licensing and Compliance Monitoring Branch at Alberta Health
What can be appealed
A refusal to issue, amend or renew a licence can be appealed by:
- continuing care home operators
- supportive living accommodation operators
An administrative penalty can be appealed by:
- continuing care home operators
- supportive living accommodation operators
- home and community care providers

Concern resolutions
A concern resolution request can be made where an applicant, operator or provider has an initial concern regarding a decision. Examples include but are not limited to:
- issuance of a notice of a contravention
- timelines to rectify a contravention
- disagreement on a decision regarding licensing
- decisions relating to, or status of an application, a renewal, collateral requirements or the terms or conditions of a licence
Open a concern resolution request
If you would like to start a concern resolution request, email a request for review to Alberta Health Continuing Care Licensing Office to [email protected] within 10 days of the issue, decision or concern being disputed. Include the following information with your request:
- name of continuing care home operator, supportive living accommodation operator, or home and community care provider
- name and address of continuing care home or supportive living accommodation
- contact information for the person submitting the request
- the specific decision, issue or concern being disputed
- evidence that was provided to the inspector at the time of decision (if applicable) and/or any evidence or information relevant to the concern
- why the operator or provider believes the decision or action was inaccurate or inappropriate
