Child Support Recalculation Program – Know your rights

Once you are registered with the program, you get several rights.

Right to object

If you do not agree with a recalculation decision by the Child Support Recalculation Program, you have the right to object to the recalculated child support amount within 30 days of being notified of the decision.

Right to privacy

We will keep both parents’ contact and other personal information private. It will not be disclosed, except as required by law. One exception is the income information used to calculate child support.

Right to consent to recalculation

In some self-employment situations, both parents must provide their income information to us if we are recalculating:

  • proportionate shares of special or extraordinary expenses
  • monthly support in shared or split custody (parenting) situations

Payor's consent

We may seek consent from the payor if their child support will increase based on income information (from the other parent) that shows:

  • involvement in a private corporation or partnership
  • significant self-employment income

In these cases, the payor has the right to choose if they want to proceed with the recalculation.

Recipient’s consent

We may seek consent from the recipient if their child support will decrease based on income information (from the other parent) that shows:

  • involvement in a private corporation or partnership
  • significant self-employment income

In these cases, the recipient has the right to choose if they want to proceed with the recalculation.

Right to withdraw or waive calculation

The parent who registered with the program can also choose to withdraw from the program or ask not to recalculate for any given year.

After a parent withdraws from the program, the other parent is notified of the withdrawal. Recalculation will continue if the other parent then registers with the program.

Right to obtain income disclosure

Registering with the program gives each parent the right to see a copy of the income information the other parent has provided to the program – on their file in Recalculation Info Online (RIO).

We remove certain parts of the parent's personal information, such as marital status, Social Insurance Number, contact information and other information not used to calculate child support.

Right to return to court

When parents are registered with the program, they both have the right to ask a court to vary their current order. If a new order is granted, a copy should be sent to us as soon as possible.
