Overview
If passed, Bill 45, the Critical Infrastructure Defence Amendment Act, 2025, will continue to help protect essential infrastructure. It will also move the definition of the critical border zone that was added to the Critical Infrastructure Defence Regulation in January 2025 from the regulation into the act, so the definition of essential infrastructure is in one place.
Proposed changes would make several amendments to the Critical Infrastructure Defence Act, clarifying the application of the act and updating the definition of essential infrastructure.
The Critical Infrastructure Defence Act protects essential infrastructure by creating offences under the act for trespassing, interfering with operations or causing damage, protecting Alberta’s economy, industry and prosperity.
Key changes
If passed, Bill 45, the Critical Infrastructure Defence Amendment Act, 2025, will:
- explicitly state that the Critical Infrastructure Defence Act applies to the Government of Canada
- update the definition of essential infrastructure to add facilities where oil and gas production and emission data and records are held
- combine the definition of essential infrastructure in one place by including the 2-kilometre-deep border zone north of the entire Alberta-United States border, as designated in the Critical Infrastructure Defense Regulation in January 2025, in the act

Next steps
