Alberta Child Welfare Class Action Settlement

If you were injured while under the care of Alberta Child Welfare, up until February 19, 2008, you may be eligible to receive a settlement.

Overview

The Settlement Agreement resolves a class action lawsuit regarding the alleged breach of duty by the Director of Child Welfare and others to make claims under crimes compensation legislation or file lawsuits on behalf of Class Members.

You are considered a Class Member and are entitled to make an application to the Victims of Crime Financial Benefits Program if you suffered injuries as a result of a crime before or while under:

  • a permanent wardship order by Alberta Child Welfare from July 1, 1966 to February 19, 2008
  • a permanent guardianship order by Alberta Child Welfare from July 1, 1966 to February 19, 2008
  • a temporary guardianship order by Alberta Child Welfare from July 1, 1985 to February 19, 2008

Making a claim

The deadline for class members to make a claim was January 15, 2017 and we are no longer accepting applications from class members. If you have specific questions about the settlement agreement details contact the McKenzie Lake Law firm as they are the Class Council for this case.

Legal fees

As part of the settlement agreement, the defendants have agreed to pay $750,000 towards reasonable lawyer fees and expenses for Class Members. This is for Class Members collectively, not on an individual basis. The remaining legal fees are payable on a contingency fee basis, being up to 10% of all applications approved by Victims Services for Class Members and 33.33% of all applications approved by the independent adjudicator in the alternative claims process.
