This release was issued under a previous government.

McColman & Sons Demolition Ltd. was also fined $20,000 for operating the unauthorized landfill.

The company pleaded guilty to one count of knowingly operating a landfill without registration under the Environmental Protection and Enhancement Act and one count of conducting an activity related to the destruction of a wetland under the Water Act. The company was charged on August 24, 2011.

The creative sentencing order requires that the company remove all waste from the site and address any adverse environmental consequences by January 1, 2015. A stop order has also been issued to prevent the company from using the site as a landfill for a three year period.

Creative sentencing provides the court with a range of sentencing options in addition to fines or imprisonment that address the harm caused by an offence and the prevention of future offences.
