Legislation introduced to strengthen services to children and families
Edmonton... Ensuring that children, youth and families needing support receive the most effective services possible is the driving force behind the Child, Youth and Family Enhancement Amendment Act, 2008. Bill 40 was introduced in the Legislature on November 17.
The Child, Youth and Family Enhancement Act is the legislation upon which Alberta’s child intervention system is based. The majority of the amendments in the legislation are being proposed to fine-tune and adjust the legislation, which was first proclaimed in 2004.
“The changes being proposed arise from four years of observations on how the legislation has worked in the field and feedback from ministry staff, stakeholders and Albertans,” said Children and Youth Services Minister Janis Tarchuk. “The result will be a stronger system that is even more responsive to the needs of children and families in Alberta.”
More significant proposed amendments include:
- Enhancing the privacy provided to children and youth receiving services from the Child and Youth Advocate by preventing a child’s personal advocate file from being disclosed. The proposed amendment does not prevent a child welfare file from being disclosed during litigation or inquiries. It also does not affect the Advocate’s obligation to report alleged abuse or neglect of a child. Additionally, it does not prevent the public from accessing non-identifying information from the Advocate’s Office through FOIPP.
- Ensuring that the responsibility for the final decision about the placement of a child in care rests with the person who is ultimately liable - the ministry’s director of child welfare. Appeal panels will continue to have the ability to review decisions about the placement of a child and if they deem necessary, request that a decision about placement be reconsidered by a senior ministry official.
“The intent of these proposed amendments is to ensure the services we provide children and families supports their development and wellbeing and also keeps them safe and protected,” said Cal Dallas, MLA for Red Deer-South, who introduced the Bill. “It’s important that these enhancements be put in place now so children and families in our province can benefit.”
